The Utility Notification Center of Colorado (“Colorado 811”) respects your data privacy and is committed to protecting it through our compliance with this policy. This policy describes how we collect, process, retain, and disclose personal, purchase, and other business information when providing services to you. We collect personal, purchase, and business information you provide, including your name, job role, equipment used, email address, phone number, contact information, purchase information, billing information, and other areas of interest as applicable for the transaction and service. When you purchase membership, attend training sessions, or process a locate ticket for example, we may also collect additional information as applicable, such as your credit card number and expiration date, mapping data, and more. Data can be collected via our website, https://www.colorado811.org, our ticket system, learning management portals or other technology solutions or vendors, and by calling 811 to obtain our services (our "Services"). Data may be collected through cookies, forms, and other electronic means such as log files to understand how our products and website are used and to enhance our services and your experience. We use this information to provide and maintain our ticket services, maintain our membership services, process transactions, develop products and services, analyze processes, and communicate with you.

Colorado 811 will process your information in a transparent and lawful way. Any information you provide when using our services, purchasing a product, or contacting us to request a service or purchase a product will be used in accordance with this privacy policy statement.

How Colorado 811 Collects Data
Automatically Through Our Services
Information about your chosen subscriptions is used to better provide you with relevant e-mail content. We also gather certain information automatically upon your visit to our website, including Internet protocol (IP) addresses, browser type, Internet service provider (ISP), referring/exit pages, cookies generated data, and more, the data collected on our website, forms, or via email and other systems (e.g., HTML pages, graphics, etc.), may include date/time stamp, and/or clickstream information to analyze trends in the aggregate and administer the site. Your IP address may also be utilized to infer your location, which we may use from time to time to send you more relevant content.

Except as set forth in this policy, Colorado 811 does not sell, rent, or lease its member/customer data to third parties. Colorado 811 will disclose your information, without notice, only if required to do so by law, as part of an agreement with a legislative or oversight body, or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Colorado 811 or the site; (b) protect and defend the rights or property of Colorado 811; and, (c) act under exigent circumstances to protect the personal safety of users of Colorado 811, or the public.
Colorado 811 may share data with authorized authorities via a subpoena, requests regarding damage investigations and claims guided by a memorandum of understanding between Colorado 811 and a third party, or other lawful requests, and trusted partners to help us perform statistical analysis or use of a technology platform. All third parties are prohibited from using your information for any other purpose except to provide services to Colorado 811, or as applicable in investigations, claims, legal proceedings, and they are required to maintain the confidentiality of your information.
Colorado 811 does not collect, process, or disclose sensitive personal information, such as race, religion, or political affiliations, if known. We may use social media, Customer Relationship Management (CRM), other Software and System, and Website tracking technologies, which may include but are not limited to Google Analytics, Facebook Pixel, Instagram, LinkedIn, and other similar platforms.
We have implemented measures designed to secure your information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers or clouds and our employees undergo annual cybersecurity training.
The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access or systems or services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas, social media, or message boards. The information you share in public areas may be viewed by other entities.
Unfortunately, the transmission of information via the internet, cloud storage pathways, in system platforms, or email may not always be completely secure. Although we do our best to protect your information and employ commercially reasonable cybersecurity measures, we cannot completely guarantee the security of your information transmitted. Any transmission of your data is at your own risk. We are not responsible for circumvention of any privacy settings, data hacks, or security measures contained on our website, systems, or other technology platforms.
Ticket System User Ticket Data
Colorado 811 will not share, sell, or distribute locate ticket data with any third party unless an alternate email on the ticket was provided by the ticket originator during the ticket creation process, a lawful subpoena has been received by Colorado 811, or a lawful investigation or claims review by authorized investigative or claims review parties outlined in a valid Memorandum of Understanding (MOU) between Colorado 811 and other party as demanded as such by Colorado 811 has been requested. Data shared is restricted to the investigative or complaint claims review parameters. No data outside of the applicable parameters will be shared.
Basis of Collecting and Processing Information
We will use your information when the law allows us to support damage prevention and safety. Most commonly, for the provisioning of services, and we may process your information in the following circumstances:
Where you consent; or
Where it is necessary for our legitimate interests (i.e., we have a business or commercial reason for using your information) and your fundamental rights do not override those interests.
Our legal interests may include:
Providing high-quality customer service.
Complying with laws or regulations that apply to us.
Developing our services, and what we charge for them.
Seeking your consent when we need it to contact you.
Providing our customers with high-quality service features.
Keeping our marketing updated and relevant.
Failure to Provide Information
Where we need to collect information by law, under our governance policies, or under the terms of a contract or service we have with you, and you fail to provide that information when requested, we may not be able to perform the contract or service we have or are trying to enter into with you (for example, to provide you with utility location services).
Profiling
We will not use your personal information for decisions based solely on automated processing if the decision has legal effects concerning you or if it significantly affects you unless you give your explicit consent for this process.
Sharing Your Information with Third Parties
Except as set forth in this policy, or in any of our other applicable privacy policies, we will not sell, lease, or provide any of your information to any third parties unless: (1) we have your permission to do so; (2) are required by law; or (3) pursuant to an agreement with a third party. Subject to other provisions of this Privacy Statement, we share your personal information with the following categories of recipients:
Members, subcontractors, and excavators. We may disclose your information with our members or subcontractors for the purposes identified above. In these cases, the third party or subcontractor will be obligated to use that personal information in accordance with the terms of this privacy policy. Your information may be shared with these types of members and subcontractors:
Companies, municipalities, individuals who own and/or operate underground utilities or underground facilities or local damage prevention and enforcement programs, and subcontracted service providers including locate service providers and excavators.
Customer Relationship Management (CRM) service provider, ticket management platforms or other technology vendors and partners.
Marketing and analytics providers.
Webinar service providers.
Third parties as permitted or required by law. This may include disclosing your personal information to regulators, or law enforcement authorities, including the Colorado Underground Damage Prevention Safety Commission (or any home rule municipalities or their agents performing similar functions). We may transfer and disclose the information we collect about you to comply with a legal obligation, including responding to a court order, to prevent fraud, to comply with an inquiry by a government agency or other regulator, to address security or technical issues, to respond to an emergency, or as necessary for other legal purposes.
As part of a business transaction. In relation to an ongoing or proposed business transaction such as a transfer of the ownership or operation of Colorado 811 or any companies in its group to another organization, if we merge with or are acquired by another organization, or if we liquidate our assets, your personal information may be transferred to a successor organization. If such a transfer occurs, the successor organization’s use of your information will still be subject to this statement and the privacy preferences you have expressed to us.
User Ticket Data
Colorado 811 is committed to protecting the confidentiality of user ticket data. Colorado 811 will only provide access to ticket data to: (1) ticket management platforms or other technology vendors, (2) authorized accounts users for tickets on their account; or (3) Members who own or operate an underground facility located in the relevant dig area as related to their user account or individual ticket / dig area.
Users cannot request to duplicate a ticket originated by another user or themselves, receive singular or aggregate data originated by other user or ticket originator, but instead they must originate a new ticket.
Homeowners or Sub-Contractors who request information about a ticket they did not originate will only be provided information from the “Work Type” and “Caller Type” data fields. Positive Response data is not provided to any user who did not originate the ticket unless they are directly incorporated in the ticket as an Alternate Contact.
If a user provided Colorado 811 with your personal information as an Alternate Contact, and you would like your information deleted from our system, please email us at administrator@co811.org
State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information.
California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia provide (now or in the future) their state residents with rights to:
Confirm whether we process their personal information.
Access and delete certain personal information.
Correct inaccuracies in their personal information, taking into account the information’s nature processing purpose (excluding Iowa and Utah).
Data portability.
Opt-out of personal data processing for:

Security
We are committed to ensuring that your information is secure. To prevent unauthorized access or disclosure, we have appropriate technical and organizational measures to safeguard and secure your information.
In case of a high-risk information breach, and depending on the circumstances, we will inform you about remedial actions to prevent any further misuse. We will also notify the relevant authority or authorities of the breach.
Unfortunately, no security measures are completely secure. Therefore, we cannot guarantee that your information will not be disclosed, misused, or lost by accident or by the unauthorized acts of others. Further, we cannot control the dissemination of information you post in the public domain, and you should have no expectation of privacy in respect of such information.
Employees and temporary workers must follow policies and procedures and complete confidentiality training to understand the requirement of maintaining the confidentiality of information. If they fail to do so, they are subject to disciplinary action.
Information Retention
How long we retain your data depends on the type of information and the purpose for which we process your personal information. Generally, Colorado 811 retains ticket information for 3 years from the origination date of the ticket. Other information may be retained for a period longer as necessary for audit, financial oversight, and processing purposes, plus any statutory period during which we need to retain the information to resolve any legal claims.
Information processed for providing services related to the marking of underground utility facilities and for marketing purposes will be retained for as long as you remain a member. However, certain personal information related to your account will be retained for up to three years after you cease being a member. If you have subscribed to receiving marketing information from Colorado 811 but have ceased engaging with Colorado 811 emails or offered content, your personal information will be erased after three years of non-engagement. Please note that it may not always be possible to completely remove or delete all your personal information from our databases without residual information because of backups and other reasons.
Individual Rights
To exercise any of the following rights, please contact administrator@co811.org. If you need to escalate a matter or feel that your issue is unresolved, please contact us via phone and ask to be connected to the information technology or data governance department of the business.
You will not have to pay a fee to access your personal information (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive, or excessive or for aggregate research activities and requests related to your information. Alternatively, we may refuse to comply with your request in these circumstances.
We may need to request specific information from you to help us confirm your identity and ensure you have your right to access your personal information (or to exercise any of your other rights). This is a security measure to ensure that personal information is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.
Right to Request Access: You have the right to request details of your personal information that we hold. Upon request, we will provide a copy of such personal information within a reasonable timeframe.
Right to Rectification: If you believe that any personal information, we are holding on to is incorrect or incomplete, please contact us as soon as possible at the address above. We will promptly correct any personal information found to be incorrect, though we may need to verify the accuracy of the latest information you provide to us.
Right to Erasure
To the extent legally permissible, you may be entitled to have certain personal information erased in the following circumstances:

The personal information has reached the defined retention period, but you require the personal information to establish, exercise, or defend legal claims.
You object to the processing of information pursuant to the right to object as described above. The processing may be restricted, pending the verification of whether Colorado 811 legitimate grounds override your rights.
Right to Portability
You have the right to receive your personal information in a structured, commonly used, and machine-readable format. Colorado 811 will assist in transmitting such information to another entity, upon request, to the extent technically feasible. Note that this right only applies to automated information which you initially provided with consent for us to use, or where we need the information to perform a contract or service with you.
Right to Revoke Consent
If you have contacted us for purposes of obtaining locate services, you have consented to the processing of your personal information as we are required by Article 9-1.5, C.R.S. (the “Notification Law”) to obtain and retain information necessary for us to process a notification. You may revoke such consent by contacting us and unsubscribing from all emails from us. However, if you withdraw your consent, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you revoke consent, we may no longer be able to provide you with services related to the identification of underground utility facilities.
